It takes 2~4 weeks from capture the hand issued summons into the PDRM system.. been there, received the same treatment.. :(
 
Ok have read the High Court case and the Road Transport Act referred to in the youtube link posted by funfer_fahrer.... looks very true...

The Saman Ekor is merely a written complaint that you have allegedly committed an offence. If u admit and pay the matter ends. If you dun pay, they cant blacklist u and prevent u from renewing ur roadtax as the Saman (written Complaint) is not a "..matter or case with the RTD..." (which under S.17(1)(d) RTA 1987 allows blacklisting) .... so if u dun pay, the matter is called up in Court and if u dun appear, a warrant of arrest is granted...then it becomes a 'matter or case'.....

The High Court said that the act of blacklisting in this instance is tantamount to compelling us to admit to the alleged offence and pay the compund for the said alleged offence.

So...in gist the gomen knows this and with the recent ammendment on 1st Feb 2011, that the pictures taken before that date are not admissible as evidence of a speeding offence....they are jus trying to fool the people and collect as much as they can...if u pay hereafter...sucker!

I'm thinking of using this challenge and see if they try and blacklist me...should be interesting....

Dei, You know it will not be easy as that. These same bunch of ppl interpret the law to their own whimps and fancies. If push comes to shove they will just amend it. Anyhoo....they are still the majority. But we are threadin into dangerous waters now. Goodnite.

The interpretation as done above is correct but as u say, they (RTD/Gomen) will interpret it in their own myopic manner... So I may wait till a summons is given to me to attend Court..and lets see what the traffic Court has to say on the High Court case which they are bound by precedent to follow as there has been no appeals on that decision.... itching to try my own case ler

..I hv knwn abt this many2 years ago ...infact a lady in Terengganu went to court and won over this blacklisting thing. :listen: I hv a string of summons the length of LPT and Im staying put in my shed to see what happens.....:biggrin:

As for you bro br, go for it man! You hv my support. Who knows yah, I might just need your services if ever my time is required to go to court :top:
