I got suspended from work

I personally know someone who received RM200k compensation for unlawful dismissal from a very large US based MNC. Took a few months for her to fight and she didn't give up. So the company eventually settled with her. All this was done this year in the thick of the economic turmoil.
 
In this difficult times, many companies are trying to downsize by trimming down. There are many ways of doing it. The company I am working for is in the process of hunting down the people with a constant record of MC. So, far 450 people have been identified to be terminated. In your case Tamade7, I can see that you like to go against the flow by being vocal. Whether it is a good thing or not it doesn't really matter. What matters now is that you are now being identified. How good your previous track record now also does not matter. Bottom line, they want you out of the system. You better have a plan if you still want to stay in your company. For the record, 99% of the time my company loses in the Industrial Court. From this fact I can assure you that most Malaysian companies are still in their jurassic age when it comes to industrial relations especially things pertaining to unlawful dismissal. And if you succeed, things will never be the same again.
 
Yaa, good option to leave the Company especially when your heart is no longer there. But my advise, stay and fight until u clear your name. Then if u want, u can leave the Company with clean record.

i personally know someone who got close to RM1mil as compensation for his termination. he's at director level at a multinational company. when he was retrenched, he got a few hundred k... supposedly no more strings attached. he then sued for wrongful dismissal and with the help of his ex-colleagues, he got another few hundred k... so tamade7, start getting close to your colleagues...
 
Guess what guys? I got another show cause letter for not signing the first show cause letter. Suspension extended for another three days. Pretty interesting eh?
 
are there yearly appraisals done?if u have been geeting good to excellent ratings, then u can walk away with a nice parting gift. seems the co is out to get you....might as well make them pay for the new M3 before u leave :)

No, it is not petty. They are systematically gathering all the reasons to sack you.

You could also answer them back and say that they are also at fault cos the person who handed over the letter to you did not ask you to sign for it. Dont forget to answer all show cause letter. Ask them to sign for it and make sure that you cc to an independant party as well. Also checked whether there is a column for you to sign the receipt and date of receipt.

look for little thing like date, authorised signature, date of receipt, different in the date of issue.. All this will help to you to make claim when you want to sue for wrong dismissal.

Dude, sorry to hear about this.

I think its starting to get personal. Be careful, mate. Since they have extended for another 3 days, why not seek professional opinion and the Industrian Relation Office at Perkeso building at Jalan Ampang (near GE Mall). I am sure they will point you in the right direction.

Signing the show cause letter is required but normally this is a small matter where the Company will just remind you to sign. There's no need to extend or issue a 2nd letter. Unless you have make a drama during the 1st issuance. If not ... I agree with Jarance, they are starting to line up.

My sincere advise, dont be emotional bro. I agree that u must be angry and frustrated, but that will not help u. Just be calm and handle this professionally. And remember, from now on, everything must be in black n white.
 
show cause letter is for you to justify/explain on your wat-so-called misconduct/s. nothing to be sign!!

just make sure you respond within the given time.
 
Just squeeze them for every single dime. No mercy. Remember you dont have anymore friends in the company. I have been thru this, and I have been with these fcukers 20 years. Didnt get a sen but I got them bigtime thru another option. Just be calm, think of your options, everything in black n whilte. Fcuk the company, you no longer wish to hang around.

Very dangerous word. Meaning if competitor offer u money for your company database, u will provide!.. :eek:

I believe this is a small world. What goes around comes around.. be professional.

A vendor recently offered a contract to our company for product A and he told me he can mix some inferior quality items in and if spotted, he willing to swap one-for-one. Margin earned we split. I told him no thank you, I want to earn my GTR the proper way. Just hope one day after I retire, I won't fcuk myself for being a fool!

Astroboy, I meant working for money as honestly as your conscience allows. So long as you can sleep at night, you know? And no selling of database to competitors. I believe you did the right thing, the GTR will come and you wont feel like you con somebody everytime you start the car.

Jarance, I was lucky in that it takes time to train someone to take over my job. My position at that time was untenable, either I go or my boss goes kind of situation. Who's wrong depends on who you talk to lar. So I quit,did nothing for 2 months while they stewed in a slow cooker. Eventually they called me back as a consultant. Paid in USD at the height of the '97 financial/Anwar crisis and posted to Tokyo for 2.5 years, to boot.

Anyway, back to the thread-starter, hope you are able to iron out the issues with your company. Every situation is different so there is no cookie-cutter solution but the most common issue is someone in the company wants you out. It is how you deal with this person that determines how you will come out from this situation. All the best, keep us posted.

Good one there astroboy. I would rather earn my money the "clean" way. No point making short term gains because end of the day, it will come back to haunt you. Have seen it happening to many colleagues of mine who had taken the "bait".

Hee hee, but of course, I am kicking myself... could have gotten myself a replacement beemer now... oh well, would rather stay clean.

It's confirmed that they will held a DI next Mon. They issued me a second show cause because I did not sign and return back the letter as instructed by my manager. In the show cause letter they say it was a grave offense that I did not follow my manager's instruction. That offense will lead to disciplinary action including immediate dismissal. I replied saying I had a bad headache at that time with proof of medical receipt and medication. They did not accept my answer and decided to charge me together with all the other allegations. This is starting to become a joke haha.....
 
I have been following this thread with interest...

Was in your shoes a lifetime ago, anyways:

- go by the book
- stay calm and collected
- refrain from hurling abuses nor threats
- record everything, even conversations/meetings with a recorder
- keep all proof in a safe place. NOT in the office & NOT at home - if possible more than one copy
- seek professional legal advice [not any T,D&H but a professional lawyer dealing with labor issues]
- stay focused to what you want out of this [there is always a sliver lining on a cloud]
