I am wondering if I have a case here whereby I got a show cause letter and need to answer it within 5 days. Management accused me of quoting below our price list. All of our sales staff do this including my manager too but they are not getting any disciplinary actions. They also accused me of signing dealership letter to customers. It was not clear at that time whether I am authorized to sign but once memo was out prohibiting me from signing, I didn't sign any dealership letter since. Lastly they accused me of selling to company A where they have earlier instructed me not to. It was without my knowledge that company A bought from company B where company B bought from me. Management now thinks that those are of very serious offends and will do whatever it takes to get rid of me. What should I do? Am I guilty?

All is not lost! It is just a show cause letter and you still have the chance to explain and clarify. If the Management is still not satisfied with your reply, then a Domestic Inquiry will be called. You still have the time to defend yourself. In the meantime, state the facts as you have mentioned above in your reply. Also, do some homework to source if there are any SOPs or Chart Of Authority in your company. This will strengthen your case. Good luck :top:
 
Oh bro I forgot to mention that I am very vocal in the company and they have been targeting me for a long time now.

looks like the company is trying to find fault and get rid of you. how long have you been with the company? how is the company business doing?
are there any black and white stated that you cannot sell below price list? as for the dealershop issue, they cannot do anything because you have stoped after the letter was issued.
on the company A and B issue, does any of your colleaques or managers knows that A bought from B at the point of time? if nobody knew, then you have a reason for not knowing. if everybody knows except you, then you'll have a bit of a problem there.

at this point of time, reply the show cause letter and explain everything in detail. they can only issue you with a warning letter. if they terminate you, you can go to the industrial court and report that you are being victimised.

I have been with the company for almost 6 yrs now. Company business is doing good relatively despite the downturn. I do not know if there is any black and white on the selling below price list issue. Nobody in the company knows who company B sells too including me.
 
Bro... I do Industrial Law.. jus answer the show cause with facts, figures and time lines..get it down all clearly..issue by issue raised. dun leave out anything.. refer to memo's etc

Malaysian labour law favors the employee, when in doubt, the judge will rule in favor of the employee. Employers mostly lost their cases in Malaysia which is turning off foreign investor, big time!

Unless there were already plenty of warning letter issued to you on repeated offenses over the years, then u r screwed!

Otherwise, the longer u drag, the better it is because all yours years of dragging the case, goyang kaki at home when not attending court, you still get paid (full salary) end of the day. Maybe time to look at F10.. :wink:

don't worry bro, not so easy to terminate an employee..some more 6 years already.
 
after 6 year and this is happening to you ....maybe some1 whom you trust / share all your working strategies is your hidden enermy there....usually such case happens when someone is getting gready for promotions and special perks ...
 
This is very true unless the employer has followed all the due processes and documented that all down i.e. warning letters, counselling, etc. Been through it, in terminating a non-performing employee.:rolleyes:

Waa dont know that we have quite a number of HR Practitioners here.

BTW, Show Cause Letter is just a standard procedure for HR when facing misconduct/disciplinary problem. Its a way to clarify things when the Company/HR is in doubt and for you to explain and state your facts. For a start, dont get nervous or excited, just reply to all the allegations. If you can contest their allegations with facts n figures, there's nothing that they can do to you.

Office politics ... yep! experienced that... a few times in different companies.

I was once issued a show cause letter because the Malaysian government hike up the diesel price.
This causes my company fuel expenditure goes up by RM250K the following month:eek:
The funny thing is the CEO has earlier relieved me from this responsibility; negotiating with the oil company for a firm price in his hand-written note to my HR manager.
I just explained all the fact without reveling that I still have this note (actually until today, although I no longer work with this company). No DI was called.

With the current company, I was given a warning letter for being involved in a few accidents. I got hit from behind in a 4 car pile up. And the other time a bus hit me somewhere near Proton in early morning traffic. I was in the second right lane and the bus just rammed from the left when the road merged from 5-6 lanes into 2 lanes.
I answered with facts and NFA. Actually this HR GM has a gripe with me due to some work related matters. Ha-ha, she got the other end of the stick when she was terminated recently.:top:

No.. I am not vocal, I am just a normal staff, who does his work diligently. If the company is not happy with me, I just look for another job, it is their loss. I intend to be happy where ever I work. If I am not happy, I will go work some where else.
 
just give the show cause letter..n after that u make your own decision la..either stay or go away..tepuk dada tanya selera:top:..tapi jgn ikut hati..:listen:nnt mati lor..
 
Once Show Cause letter issued, the management would have lost the element of trust in you and would be an uphill journey for u regardless of whatever the outcome of the case. I say keep your option open for jump ship! but compensation die-die must fight la!
 
bro sorry to hear that... better get some professional assistance on this as i am pretty sure the company will get some too. if all else fail, make sure you are fully compensated... good luck!
