PART 2: I could have been seriously hurt, or DEAD!

I had started another thread HERE. I think it was similar in seriousness and nature. I am actually looking for guidance and advice on what should i do based on the mishap that i experienced. All comment and suggestions are highly appreciated.. no speculations pls..:top:SO, Ive sent one of my cars to an authorized dealer recently. Given the option, where else would you send your beloved car to, right? of course they're plenty of independent workshops outside, which are even more experienced and would not hurt your wallet as much. However, i expect being an established dealer, they would be the most competent, and would also offer warranty on the parts and labor.. Works were on some parts change and servicing.. picked up the car, paid a hefty bill (which is fair for what they are), and drove off..so, everything seemed fine.. after around 7-10 mins of driving, the car was shuddering, i immediately slowed down and wanted to move to the emergency lane to inspect if anything was wrong.. there was a loud thump, and before i can fully stop, i can see one of my wheels flew past my car!!Lost control of the car, but managed to catch it and stopped just shy of the emergency lane. called up dealer but no one picked up.. a really good friend came with a foreman and assisted by taking a nut from the other wheels that were still intact. the front wheel was also loose!! took picture of the whole mess, made police report and wrote in to the said dealer, with cc to the principal. sigh... what if i end up in the wall? Imagine if my wife was driving, or my 18 yr old brother, or my 57yr old mother.. what if my kids were in the car? what if the tyre hit a pedestrian, or a motorcyclist? really disappointed that this thing had happened..the issue here is NOT what damages sustained and need repairing, but more of the critical error done by an authorized dealer, which could have been fatal![FONT=&quot] [/FONT]what do u guys think?
 
Sorry to hear that bro ... What you did after the incident was absolutely correct :top: well done, Did you manage to get any immediate reply (phone calls or email) yet from the dealer and the principal??? can you name the dealership for the benefit of everyone here?
 
Which is one of the reasons why after sending my car for service, I always run through the whole car with the mech, checking to see everything was properly secured. Before I practised that, I once had the radiator cap "blow out" on me, lost my oil cap, lost engine power because the MAF socket was not properly plugged in and almost lost my wheel (like adliz) when the tyre man had not tightened some wheel nuts properly. I was lucky, I only had one wobbly wheel and no, it did not overtake my car....:eek:
 
As for compensation, well, usually you can only claim your actual loss... as for the what-if losses, tough luck. Something similiar happened to my wife. She took a slip due to the negligence of a resort and broke her ankle. Not once did the resort show concern and took my wife to a hospital. I had to do that myself. Worse yet, the resort at first did not want to admit their negligence. My wife had to go to a specialist hospital for treatment. That was not the worse part. The worse part was her recovery. She had to be on clutches for a few months, had to endure the pain while the bone healed, the agony and suffering she had to go through and her ankle off and on now still suffer pain.

Well, we had to threaten with court order before the resort responded. Well, at first they wanted to throw us off-track with legal jargons, that my wife was also at fault, etc, etc. We persevered with what we want... in the end, we were only compensated for all medical charges, travelling costs incurred in getting all medical treatment, basically direct consequential costs/losses. As for her suffering, nothing. Oh yeah, we were only compensated a year later.

why do we malaysians have to take all this poor service crap and endangering our lives in the process? you won't find this in the west. can't say much about china, japan or india tho'...

you have been wronged. take immediate action
 
If you don't mind sharing is this a BMW dealer or VW? I am shocked at such carelessness.

thanks man.. i got 3 cars, all bought from different dealers.. no speculations pls.. kekke.. we'll see how this would get sorted before i decide to disclose the name..

by then, you can even look up newspapers and tv.. :wink:

unless you've suffered huge losses or bodily injury, i dont recommend taking any legal action. u will know why if u've been to the courts in msia. also, your emotional distress, anxiety, nightmares, etc aint gonna be compensated here like in the US. best is to settle out of court...make it public before demanding for the settlement so they feel obligated to compensate you more

adliz, feel sorry for you bro...hope its not your most expensive car that was involved!
 
thanks guys.. ive copied the police report to them.. we'll see how the dealer would respond.. they called me up and followed up..

any suggestions on what to ask for? im more inclined to ask for a replacement.. big chance the chasis, subframe, mountings, bushings etc are dubious now..

Tiles were coming loose at the entrance door. They just used a big piece of carpet to cover the hole. Well, at first glance, you would think that was a Welcome carpet and put your foot on it. That is just what my wife did, she lost her balance and fell awkwardly on her ankle. It was lucky she did not break any other bones. In a way, we settled out of court.... no point going to court, like what ess530i stated. But the nego with them and their insurance adjuster took almost a year, and some months for the to raise the cheque. Needless to say, we never did step foot in that resort ever again.

Wow. This has happened to me too. Due to having spacers with screws which weren't long enough. =/

Hi Adliz, sorry to hear thar from authorised do this type of shit works..
For me defernaly will take legal action,
if they still not care about this ..
Im sure will write a good story for public..

But now im still prefer send to authorised workshop more then normal workshop.

Towed it from Nilai to TTDI. =/

Lukily for me, I too slowed down when I felt the steering vibrate.
 
ouch, sorry to hear about that.
Its crazy and unacceptable!!!!

i hope you can share that dealers name here, and we can avoid going there until they fire that mechanic.
