E39 520i Engine Swap and ECU Questions

I recently found someone selling E39 520i (M52B20) but the person has swapped to a 528i Engine (M52B28). The problem is that he told me the ECU was not replaced. My question is how on Earth can a M52B20 ECU work on M52B28 engine? I understand the hardware is the same Siemens ECU but software can't be the same right? Thus I am wondering if its possible to change the engine w/o at least doing an ECU flash or change ECU.
