Unlucky Incident Coming Back From Penang...

About a month ago on the way back from penang, after Sungai Buloh something happened... I was going on 110km/h and i saw like there was something on the fast lane.. Of course anyone also will hit the brakes and slow down but when i was doing so there was a STUPID F**K Wira came infront of me and blocked my view.. (From the far left lane he straight came into fast lane without any warning) I jammed the brakes till 30km/hHe saw the thing and evade and when it came to me i couldn't do anything but to evade me tire's from hitting it.. Without realizing it went under my car and Airbag burst and car totally stopped.. I couldn't go on the left coz got car and on my right was the divider.. Slowly i steered the car to far right as i was just cruising from 30km/h..After getting out of my car i saw 3 other car was by the side of the road caused by the metal thing on the road.. Found out the metal thing was a lorry's long shaft ! ! ! IT WAS LYING ON THE FAST LANE ! ! ! =( it hit my car and tore the lower part pretty bad till it got stuck under and follow till my car stopped..3 other cars broke their rims and both left side tires was burst..Such an unlucky incident and I have send my car to AB Glenmarie.. Most of the parts on the down part of the car was hit pretty bad ( The long shaft was at least 35kg) =(Car has been there for nearly 2 months now... Best part it was there for 1 hour since the first car hit it and the BASTARD PLUS HIGHWAY didnt clear the road.. Trying to claim through PLUS but it looks so hard to do so but luckily have insurance to cover...I almost died when i heard the total amount was close to RM 35k ! ! !* all of this could go away if thar bastard wira didnt come cucuk another car in front of me, everyone could have evade it*PANASNYA HATI.....Few pictures on the accident : The Lorry's Long Shaft ( This thing weights easily 30-35kg's !!!, I cant even carry it.. )

Cases like these have been occurring.. Most of the items were left there on purpose.... More so on the fast lane... Which is why I always choose to use the 2 left lanes instead, at least still got space to 'siam' when shit happens...

And from the sound of it, the wira seem to be part of the scheme to make sure u hit the 'target'.. Or maybe it's just coincidence..

Maybe you can even try to sue them as you are the driver. The moment a ticket was extracted at the toll gate, a contract was struck between the plaintiffs (you) and the defendant (them). There was an implied warranty that the highway would be safe for the use of you.

Ha...this was one of the case laws i studied in my uni during last semester..

I did experienced b4 on the highway, but mine was more worst than urs. I do not think u can claim from PLUS or any party. The only thing u can claim from ur insurance. My case was in federal highway from shah alam to subang (underneath batu tiga flyover). It happened to be 5 cars involved included police patrol car was lining behind. There was a container wheel with tyre lying on the 1st lane. 1st car was a taxi, he totally slam break and trying to overtake between tyre and divider. Eventually, cars behind unable to slam the break even i was driving 70km/h (im 3rd car). So all the 4 cars behind the taxi just bang to the taxi. The funny thing is last car was a police car. The officer straight jump down his car and scolded whats happened, why all stop suddently. Due to the container wheel, all 5 of us have to claim insurance, but its unlikely for the petrol car , all 4 claim his insurance DDDDDD.

Can u pls explain more clearly why u think CANNOT claim from PLUS or any party ??

It was long time ago, because of lorry driver responsibility. They can say the lorry wheel just drop, and they was going to pick up but eventually accident already happened b4 they pick it up.

Thanks for the comments from everyone.. Luckily me and my dad escaped with minor scratches.. my hand was torn abit due to the airbag and my dads face swollen because if the airbag hit direct on his face... I called PLUS and they seems to be very F**KED up as they dragging things like they dont want to let me claim under them... now the only problem insurance will cover 70% and because my car is more than 6yrs or something owner must pay 30% betterment.. Now the 'sakit' part is the 30% which cost nearly 10k ! If anyone knows anyone to go to regarding the claim on PLUS please do help me out... It would e a GREAT help... It's even more pain when the accident is not your fault... =(

Sorry to hear bro, it sucks big time when something out of your control costs so much.....did you make a police report immediately? I guess to claim from insurance, you have a report already correct?

It's tough to claim from PLUS as they state on the back of their card that they are not responsible for any consequence etcetcetc, but to actually bring this up you might need court action. Which is a very long tedious process. You might need to consult a lawyer to see if anything can be done. This was definitely PLUS negligence as it is their responsibility to police the highways and make sure it is safe for DRIVING. Which they didn't do.

Hammer278 : yes it would be a hassle to make it a court case and stuff... but im really truly am pissed off with the stupid PLUS due to their nonsense... Currently my car is in AB Glanmarie and i think the process of changing parts is about to finish.. maybe will be taking the car out after Raya... =( I just got a shock to see the Bill as the prie is way too much for a mistake i didnt do but thank god there is a thing called INSURANCE...

if the amount is large and there are injuries and bills involved i reckon u can make a claim. if the sum is minor then ppl would usually shrug away from claiming. disclaimers behind tickets and receipts is just a term they put in every ticket, they cannot aviod the law if there is any serious losses. if you are insured like your car, u might not be able to claim however like i said if insurance is insufficient or there are injuries which insurance dont cover u can claim thoses expenses.
