Not really. I can see how this can be relevant, but no. Both cars were sent in almost cimultaneously. One went in in November 2009, another one was paid and booked to go in by January 2010. After that there was a fair deal of wasting time.

I must say, that not until June, that i've realised that this guy is trying to fck me and that action needs to be taken. There is only so much patience one can have. Mine expired in June. Besides, my first car, was not compromised in any way, it was withdrawn as he has failed to comply with promised deadlines. He has also failed to stay within agreed budget. But this is a whole different matter. Not even sure if i want to bring it up to Tribunal, see how first.

I believe from what you have written in this tread you are heading the right direction. Just try to state the whole history(story) which took place in your complains form. Good luck mate. Also note that you can also sue this mechanic in court, for claim below RM25k you can file your cliam in magistrate court.

thanks for encouragement bro. Will try to finalize my submission by this week. My only worry, that once he finds out, he shall further compromise my project by going to my wireman (whom he knows) and do something funny to the car which is parked outside. There is no insurance for that. Impossible to trace later.

Idea is to wait for wireman to complete his job first or until it is safely parked inside workshop.

That's terrible, it's totally loathsome the way they treat your ride. May justice be with you in your claims via the tribunal.

Thanks Suresh, i'll keep your number handy. I just hope, that process is rather informal, and easy to follow. I am just trying to avoid any blunders from my side, say what needs to be said, not otherwise.

I am sure this is going to be an interesting case and i can't wait to publish Tribunal's decision once the case is over and done with.

check with soorian. he have make a claim against Auto Bavarian before when he sent his car for repair.

p.s. I dont think you are allow the bring your lawyer to a tribunal hearing. You represent yourself but good to have some "legal" advise before you go for the hearing.
 
correct, no lawyers allowed. I'll represent myself. But its nice to get some legal advice on what to say and what not to say. Also, it is important to understand if i need to bring any evidence or seek other mechanic's professional advice (so called damage assessment done) on the car before going to court. My case is a little tricky, as i don't have as many evidence as i'd like too. Most of my claims are based on what we've agreed upon verbally, not sure if court will take this into account. Any idea on how I can strengthen my case by seeking third party assessment?

Perhaps i should call in someone to asses the damages and provide me with a detailed report on damages caused and expected repair costs?

Anyone? Any recommendations?

kgb ...sory to hear bout it ...workshops as such are just everywhere these days .... need to take extra care when dealing with such kindda workshops ...especailly those that you never heard off ...

Iceman, this is a well established workshop, for over 10 years. Their workmanship is very good.Mechanic himself is very knowledgeable. But, that fellow got one hell of an attitude. Recently, it seems, it got really bad, so he took it out on me.

There is one more thing i must reveal here (not sure if it'll make any difference to my case or not), i used to work with that guy from the time my first car entered his workshop, unofficially of course, but never the less, that i how i know, whether he did any work or my vehicles or not (i worked there for just over a year). I was one of his assistants.

No, this could not be a reason why he did what he did, because i've treated that job strictly as a hobby, and given my 110% attention and commitment. Damages to my vehicle were done well after i've left his employment. Anyways, i don't think this will work well to his defense, i still paid him (and paid premium) for whatever modifications he did on my vehicles.

If anyone thinks that this might compromise my case, pls do share.
 
Bro

You should mention the first car to put his credibility in question. If the need arise to collect the alternative way let me know can arrange. Please go all out and the publicize it to let the rest of the workshops be aware before they decide to cheat.
