Well, the rule of thumb for me has been to buy the best condition unit one can afford, so you know exactly what you are paying for.

Getting a cheap buy, then fixing it up is an alternative, but best left to the experts and folks with time and money to spend. This is actually the 4th e39 I have owned over the past 7 years and by far one of the best examples I have owned. It has been 3 520i's and a 530i and all of them have been pretty bulletproof. Despite the age, they compare incredibly well and in my opinion, are extremely competitive against even the latest models from merc and bmw in terms of build quality, quietness, smoothness and ride comfort.

Now if only there was an e39 M5....
