Am I entitled to claim for my losses?

Would like to just ask for some opinions regarding my problem now, I sent my car to a shop to get something fixed and now they tell me they lost my key and asked me to just use my spare one. Yes I have my spare key but the problem is who ever has my key can drive off my car anytime he finds my car unattended. So if I change my car's head lock and alarm system, do I have a right to claim it from the shop owner who lost my key? Even now if he tells me he found it back I would still be afraid they already duplicated it. Sigh...
 
Really sorry to hear this happen to you, I can sense your grief.

For a start, perhaps you could make a police report, as key theft and attempted theft of car, then use that as leverage against the shop - if the car is stolen they'd be the first suspect.

Is your key a electronically coded key with immobiliser?

My previous e39 was purchased without a spare key, apparently it was also "lost" at some point. One yr later, I traded-in back to the same shop (Cheras) and the car was stolen from them the very same night. I believe it was with that missing key because it was an electronically coded key, so couldn't have been forged without a record from AB.
 
No no mine is just a normal alarm, so what do I say to the police when i lodge a report? I can lodge a polise report saying I lost it in the shop i sent my car to? thx.
 
Best pple to speak to are the police themselves. Try to explain that the keys were in fact stolen and not just "lost".

In the meantime, you'll need to be very very careful and get a huge steering lock (or remove essential bits to disable the car) until you change the lockset.

Shop can say/do anything they like at this point... perhaps someone here will come along with better advice.
 
My humble opinion is that you change the locks and even the alarm...you'll sleep better I assure you....you should talk to the shop rep and get them to bear all or part of the cost....and if the don't, tell them that for starters you will post their irresponsible act on the forum for all your "thousands" of bros to see and following this we will all boycott and blacklist them accordingly....
 
Actually all of you here will know who they are but for now I am not going to mention it to kill their name unless they are not going to compensate for it. Atleast my car is in another work shop now and is locked inside, if not I wont be sleeping at all lol.

By the way how much will the whole lock set cost me? And is it a must to change the alarm system also? I am really so pissed about this now....
 
If you have a fairly advanced alarm then you'll be able to re-program the main module to exclude the stolen remote's ID. Then just get a replacement remote and program it's ID into the main module.

Good grief... sorry to hear of your unfortunate experience.

I would get a quote to change the entire lock set, and ask the workshop to settle that. And it wont be cheap.

Go to Tribunal Pengguna, they definitely can help u to claim back the lock and alarm changing fee.

seek some legal advice. send them a letter from your lawyers.
 
Sorry to ask but what is tribunal pengguna? I just hope they will be fair enough and just fork out for what I am suppose to change....
 
Tribunal Pengguna is something like government lawyer stand by pengguna site, they will fight for u. can searh the detail in YAHOO. Better ask their advice.
 
Thanks alot guys, will be going there again tomorrow to see how he wants to settle this. If possible I would like to settle it fairly and without any arguements, anyhow after this incident I dont think I can send my car there anymore......

Know your rights, and you will be able to negotiate better. They will sense this, and give you a better settlement.
