Here's the scenario:3 parties are involved in this scenario. Seller S, Dealer D and Buyer B.S wants to sell his car through D. D found B. B issued a cheque to D as deposit to secure the car. Few days later. S backed off citing personal reasons and disappear. No documents have been signed between S and D. Only an official receipt was issued by D to B on the purchase of the car. B now wants the money back from D citing no car no deal. D kept delaying B on the refund. What avenues does B have to get the money from D?1. Consumer tribunal - do they have the powers to ask Banks to reverse the cheque clearance even though its been cleared. This seems to tbe the fastest way. What if D ignores the court letter?2. Through a lawyer - don't think this make sense as the deposit is not a huge amount. Couple of thousands only. What's with these dealers nowadays. Few millions ringgit worth of inventory and they don't want to refund your blardy money!!!
