What's the thing with car dealers nowadays?

Here's the scenario:3 parties are involved in this scenario. Seller S, Dealer D and Buyer B.S wants to sell his car through D. D found B. B issued a cheque to D as deposit to secure the car. Few days later. S backed off citing personal reasons and disappear. No documents have been signed between S and D. Only an official receipt was issued by D to B on the purchase of the car. B now wants the money back from D citing no car no deal. D kept delaying B on the refund. What avenues does B have to get the money from D?1. Consumer tribunal - do they have the powers to ask Banks to reverse the cheque clearance even though its been cleared. This seems to tbe the fastest way. What if D ignores the court letter?2. Through a lawyer - don't think this make sense as the deposit is not a huge amount. Couple of thousands only.What's with these dealers nowadays. Few millions ringgit worth of inventory and they don't want to refund your blardy money!!!
 
When B pay deposit to D, the car is reserve for B. B should ready to loss the deposit if he fail to arrange the loan unless B state clearly when he pay the deposit. D is taking risk in the mean time which he has to refuse others potential buyer whose interested the car.
 
If i were B :

1) Will talk to D 2geter with the official receipt issued by him and ask for refund since D can't produce the car.

2) If D refuse to refund will bring the case to Consumer tribunal Dept, make sure keep the official receipt issued by D.
 
Oppss, i miss the statement "S backed off citing personal reasons and disappear".

If D refuse to refund, go for Tribunal!

does it really work with tribunal dept? I mean what are the chance D rubbish it?
 
No matter it works or not with tribunal dept u need to try since the D was not holding his words. If you provide the official receipt which issued by D i believe there will do their job. If the dept not doing their job go refer any opponent politic party service dept. Or call some taiko to talk to this in responsibility D at the last stage.
 
I saw some banners on lamp posts recently, "Kutip Hutang Cara Halus". Could be tried here heheh.

I wonder how 'halus' its gonna be hehehehehe
 
Next time if u come across again pls mark down the contact number and post it here, who knows it works for such case.
 
Finally B got the cheque back after threatening court order....still baffled on why it has to end this way....D is a multi-million ringgit business and B just wanted his couple of thousands back..

unfortunately that works only for millions/jutaan ringgit sahaja.

Since, the buyer have got his refund, this case is closed.

I think it would unfair in discussing further if the intention is to tarnish name of the seller.
 
these days it's better to get the seller"S" OR dealer "D" to state down the condition for the deal in black n white ...case if the deal turns sour the distribution of payment/deposit and penalties shall me made in the said mentioned manner which is stated black and white...

pls don't forget to indicate the said mentioned car type / reg number / and the witholding period for the loan approval and case if rejects what happens ...

S and D these days have lotsa magical power ..usually S backs off when there is another dealer that had given him a higher offer with a ready buyer ....
