Need advice for ap issue ..

Hi, ask on behalf of my friend.His own a used bmw as a 4th owner bought from car dealer, within a year he found that the car got AP issue, he did try to request for full document from the car dealer but they try to ignore my friend question & said lot of story.. Need some advice about this:- 1) Can we sue the car dealer because of AP issue (i mean in not genuine) ?If yes - it's worth to do that ? (beside KPDN)If NO - got any solution ? 2) In this case, are the car dealer should responsible about this? Highly Appreciated all the comment & input advice ~~ Rdgs,3CI

Yes, you may sue the dealer due to misrepresentation and selling an item which is not sellable, barang curi and whatnot. Unfortunately the dealer may invoke the sale/purchase aggreement which may or may not state that the goods sold as is. It is due diligence on your friend's part to check all the information on the car before making the purchase. In this case however, he has a very good chance of winning the lawsuit and getting his money back due to the fact that the seller is at fault by selling illegal item to your friend.

You can also scare the dealer by getting a lawyer to write a letter informing them your intent to sue them if they would not either producing the car's AP or refund. Just tell the lawyer to put in as much as lawyer jargon and statute/law like Sale of Good Act.

FYI, since the car is without AP, it is not road legal even with insurance and roadtax. The police can and will SITA the car and it falls to the owner to claim the money paid for the car from the dealer.

Note : I am not a lawyer and whatever I said is not a legal advise, please take it with a grain of salt. Best bet is to contact KPDN for advise.

On beginning once i hear from my friend, i feel very teribble anything can happen in our land.
Already inform my friend try appoint one lawyer firm to taking action ASAP.

Beside that, do your guys have any experience lawyer to introduce?

Anymore comment & suggestion advice, welcome for input.
Im sure still have lot of victim & loss lot of money but they all doono how
settle about this issue.
